1. Acceptance of Terms

By accessing and using the pena.click platform (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you are not authorized to use the Service.

These Terms constitute the entire agreement between you and Pena Click Intelligence Ltd. (“Company”) regarding the Service and supersede all prior negotiations, understandings, and agreements, whether written or oral.

2. Service Description

pena.click provides a global legal intelligence engine that enables users to query cross-jurisdictional legal information using natural language. The Service leverages artificial intelligence, including large language models and retrieval-augmented generation (RAG), to deliver legal insights and analysis.

The Company reserves the right to modify, suspend, or discontinue the Service or any portion thereof at any time, with or without notice.

3. User Responsibilities

You agree to:

  • •Maintain the confidentiality of your account credentials
  • •Use the Service in compliance with all applicable laws and regulations
  • •Not engage in illegal activities or violate third-party rights

4. Intellectual Property Rights

The Service, including all its content, features, and functionality, is the exclusive property of the Company and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for lawful purposes. This license does not permit you to reproduce, modify, distribute, or create derivative works of the Service without prior written consent from the Company.

5. Acceptable Use Policy

The Company does not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. The Company does not warrant the accuracy, completeness, or reliability of any legal information provided through the Service. Users should independently verify all legal information and consult with qualified legal professionals.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

The Company's total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Termination

The Company may terminate or suspend your account and access to the Service at any time, without notice, for any reason, including breach of these Terms or violation of applicable laws.

Upon termination, all rights granted to you under these Terms will cease, and you must immediately stop using the Service. Provisions that by their nature should survive termination shall remain in effect.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction of Pena Click Intelligence Ltd., without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration rather than court proceedings, except where such waiver is prohibited by law.
